Welcome to the Indian Expatriates Society (IES) Platform. These terms and conditions outline the rules and regulations for the use of IES's Website, located at www.indianes.org. By accessing this website, we assume you accept these terms and conditions. Do not continue to use IES Platform if you do not agree to take all of the terms and conditions stated on this page.

2. Definitions

  • "Platform" refers to the IES website and all associated services
  • "User" refers to any individual or entity accessing or using the Platform
  • "Member" refers to registered users who have completed the membership process
  • "Donation" refers to any monetary contribution made through the Platform
  • "Content" refers to all text, images, videos, and other materials on the Platform

3. User Accounts

  • You are responsible for safeguarding the password
  • You agree not to disclose your password to any third party
  • You must notify us immediately upon becoming aware of any breach of security
  • You may not use another person's account without permission

4. Membership

Membership in IES is subject to approval by our administrative team.

  • All membership applications must contain accurate and truthful information
  • Membership fees are non-refundable unless otherwise stated
  • Members must adhere to the IES code of conduct
  • IES reserves the right to suspend or terminate membership for violation of terms

5. Donations and Payments

All donations made through the Platform are subject to the following terms:

  • Donations are voluntary and non-refundable unless required by law
  • 80G tax exemption certificates will be provided for eligible donations
  • All payments are processed through secure payment gateways
  • IES is not responsible for any fees charged by payment processors
  • Recurring donations can be cancelled at any time through your account dashboard

Important Note on FCRA Compliance:

Foreign contributions are accepted only in compliance with FCRA regulations. International donors must provide required documentation.

6. Acceptable Use

You may not use the Platform:

  • For any unlawful purpose or to solicit others to perform unlawful acts
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • To submit false or misleading information
  • To upload or transmit viruses or any other type of malicious code

7. Privacy

Your use of the Platform is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

8. Intellectual Property

The Platform and its original content, features, and functionality are and will remain the exclusive property of Indian Expatriates Society and its licensors. The Platform is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

9. Disclaimer

The information on this Platform is provided on an "as is" basis. To the fullest extent permitted by law, IES excludes all representations and warranties relating to this Platform and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this Platform and/or literature.

10. Limitation of Liability

In no event shall IES, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Platform.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

12. Changes to Terms

IES reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
